BLUECHIP MF Online – Customer Module Terms of Use:

These Terms of Use (“Terms”) governs the provisions on which the users (“you” / “your” / “user”) access and register on the website https://mf.bluechipindia.co.in and / or mobile application “Bluechip MF Online” and the other products and services, together or individually referred to as “Platform” owned, managed and operated by Bluechip Corporate Investment Centre Private Limited (“BCICPL”) offer, except where BCICPL expressly state that separate Terms (and not these) apply. This Agreement is for an indefinite term by accessing our Platform, you hereby acknowledge, understand and agree upon these Terms along with responsibilities.

BCICPL is a registered Mutual Fund distributor with Association of Mutual Funds in India (AMFI) under ARN no. - 0016 since 19th February 2002 and it is valid up to 18th February 2027.

BCICPL retains an unconditional right to modify or amend these Terms to accurately reflect our services and practices. We will notify you (for example, by email or through our Platform) at least 30 days before we make changes to these Terms and give you an opportunity to review them before they go into effect, unless changes are required by law. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products. We hop1e that you will continue using our Platform, but if you do not agree to our updated Terms and no longer want to be a part of BCICPL, you can delete your account at any time.

Clause I – Usage:

1. ELIGIBILITY:

   You must be 18 years of age or older to visit or use the Platform in any manner. In the event that you are below 18 years of age and any of the Platform is accessed, the same will be at your own risk and you alone shall be liable for your actions. By visiting the Platform or accepting these Terms and responsibilities, you represent and warrant to the Company that you are 18 years of age or older, and that you have the right, authority and capacity to use the Platform and agree to and abide by these Terms. You also represent and warrant to the Company that you will use the Platform in a manner consistent with any and all applicable laws and regulations.

2. ACCEPTING:

   By using the Platform, you agree to follow and be bound by all these Terms concerning your use of the Platform. Certain areas of the Platform may have different Terms posted. However, if there is a conflict between the Terms posted for a specific area of the Platform, the latter shall have precedence with respect to your use of that area of the Platform.

3. ACCEPTABLE USE:
   1. BCICPL shall not be liable for any damage to your computer system or loss of data that result from the download of any content, materials, and information from the Platform or use of any software, systems, functionality, or other services on the Platform. Under no circumstances will BCICPL be liable in any way for any content, including, but not limited to inaccurate, false, incomplete, threatening, defamatory, obscene, offensive, illegal content, infringement of other’s rights including intellectual property rights, for any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted or uploaded. Further, under no circumstances, BCICPL shall be liable for any unlawful act of you or your affiliates, relatives, employees, agents including misuse of any data, unfair trade practices, fraud, cybersquatting, hacking and other cybercrimes. In no event shall BCICPL be liable for damages of any kind, including without limitation, direct, incidental or consequential damages (including, but not limited to, damages for lost profits, business interruption and loss of programs or information) arising out of the use of or inability to use the Platform, or any information provided thereon, or any claim attributable to errors, omissions or other inaccuracies in the Platform.
   2. You may not send, submit, post, or otherwise transmit, material or messages that contain software virus, or any other files that are designed to interrupt, destroy, and negatively affect in any manner whatsoever, any electronic equipment in connection with the use of the Platform, or other user's ability to use the Platform.
   3. You may not conduct any systematic or automated data collection activities (including scraping, data mining, data extraction and data harvesting) on or in relation to our Platform without an express written consent of BCICPL.
   4. You may not use our Platform to transmit or send unsolicited commercial communications.
   5. You may not use our Platform for any purposes related to marketing without an express written consent of BCICPL.
4. REGISTRATION:
   1. For availing the services under the Platform, registration by you is required, for which you will receive one password and account designation upon completing the registration on the Platform. You are responsible for maintaining the confidentiality of the password, account and are fully responsible for all activities that occur under your password or account.
   2. By registering, you agree to these Terms in addition to any other specific terms which shall be posted at an appropriate location of the Platform.
   3. Each registration is for a single individual user only. To access these services, you will be asked to enter your individual User Credentials. Therefore, we do not permit any of the following:
      1. Any other individual or user sharing your User Name and Password;
      2. Any part of the Platform being cached in proxy servers and accessed by individuals who have not registered with the Platform as users;
      3. Access through a single User Name and Password being made available to multiple users on a network.
   4. If BCICPL reasonably believes that a User Name and Password are being used / misused in any manner as clarified above, BCICPL reserve the right to cancel access rights immediately without notice, and block access to any or all users from that IP address.
   5. You specifically agree that BCICPL shall not be responsible for unauthorized access to or alteration of your transmissions or data, any material or data sent or received or not sent or received through the Platform.
5. SPECIFIC PROHIBITED USES:
   1. The Platform may be used only for lawful purpose which accounts individuals for personal, non-commercial use only. BCICPL specifically prohibits any other use of the Platform, and you agree not to do any of the following:
      1. Post or submit to the Platform any incomplete, false or inaccurate biographical information or information which is not your own;
      2. Send unsolicited mail or e-mail, making unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to other user of the Platform.
   2. Prevent in usage or practice of indulging in process of sending any phishing e-mail, including any or all of the following:
      1. Delete or revise any material posted by any other person or entity; or
      2. Take any action that imposes an unreasonable or disproportionately large load on the Platform; or
      3. Attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Platform; or
      4. Aggregate, copy or duplicate in any manner any of the content or information available from the Platform; or
      5. You agree not to use / insert other User's URL, web link, e-mail address while accessing any material on the Platform.
6. TERMINATION:
   1. BCICPL may terminate your access to the Platform or any part thereof at any time and for any reason without any notice. The provisions regarding disclaimer of warranty, accuracy of information, software, database other system or functionality of the Platform and indemnification shall survive such termination. BCICPL may monitor your access to the Platform.
   2. BCICPL may change or discontinue any aspect of the Platform at any time, including, its content or features. BCICPL reserves the right to change the Terms applicable to use of the Platform. Such changes shall be effective immediately upon notice, which shall be notified to you.
   3. On non-conformance by you for any of these Terms, BCICPL may in its sole discretion, restrict or terminate the offending your ability to access the Platform and determine whether to take any other actions whether to remove or request the removal of your content. BCICPL doesn’t hold any liability or responsibility whatsoever to your performance or non-performance of such activities.
   4. BCICPL reserves the right in its sole discretion to investigate and take legal action against anyone who engages in any illegal or prohibited conduct or otherwise violates these Terms, including without limitation, removing your content from the Platform and/or terminating the offending your ability to access the platform and/or use services therein. BCICPL may take any other action with respect to your content or actions that it deems necessary or appropriate in its sole discretion.
7. COOKIES:

   The Platform may use cookies. By using our Platform and agreeing to these Terms, you have given consent to use of cookies in accordance with the terms of our privacy policy.

8. INTELECTUAL PROPERTY:

   All contents on the Platform are the exclusive property of BCICPL except the third-party content. The software, text, images, graphics used on the Platform belong to or are licensed to BCICPL. No material from the Platform shall be allowed to be copied, modified, reproduced, republished, uploaded, transmitted, posted or distributed in any form without prior written permission from BCICPL. All rights not expressly granted herein are reserved. Unauthorized use of the materials appearing on the Platform may violate trademark and other applicable laws, and could result in criminal or civil action.

9. WARRANTIES AND LIABILITIES:
   1. BCICPL does not make any express or implied warranties, with respect to any service, information, data, software, system, functionality, statements or products made available on the Platform. The information contained in the Platform has been obtained from sources believed to be reliable. The Platform, and all content, materials, information, software and services provided on the Platform, are provided on an "as is" and "as available" basis.
   2. BCICPL does not give any express or implied assurance that the Platform will operate error-free or the Platform and its servers are free of computer viruses or other harmful mechanisms. If your use of the Platform or content therein results in the need for servicing or replacing equipment or data, BCICPL is not responsible for any such liabilities.
   3. The Platform and content are provided on an "as is" basis without any warranties of any kind. BCICPL to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the fitness for particular purpose and non-infringement. BCICPL makes no warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, and links.
   4. You may not use the Platform to transmit or send unsolicited commercial communications. You may not use our website for any purposes related to marketing without express written consent of BCICPL.
10. INDEMNITY CLAUSE:

    You hereby agree to indemnify BCICPL and undertake to keep BCICPL, officers and employees, indemnified from any losses, damage or damages, costs, liabilities and expenses including and not limited to litigation fees, asserted by any third party due to or arising out of your use of or conduct on the Platform.

11. RIGHT TO PRIVACY:
    1. All the privacy will be governed in accordance with the Clause III of the Terms. BCICPL reserves the right to disclosure any personal information about you and your use of the Platform including its contents, without your prior permission if BCICPL has a good faith belief that such action is necessary to any or all of the following:
       1. Protect and defend the rights or property of BCICPL; or
       2. Enforce the Terms; or
       3. Conform to legal requirements or comply with legal process; or
       4. Act to protect the interest of its members or others.
    2. Your right to privacy is of paramount importance to BCICPL as mentioned in (Clause III of this Terms). Any information provided by you will not be shared with any third party, except in the manner provided under these Terms and for the intended purpose for which such information is provided by you, in which case your consent is implied. BCICPL reserves the right to use the information to provide you a more personalized online experience.
12. THIRD PARTY:
    1. If the Platform provides links to websites and access to content, products and services from third parties, including users, advertisers, of the Platform, you agree that BCICPL is not responsible for the availability of and content provided on third party websites. You are requested to preview the policies posted by other websites or third parties regarding privacy and other topics before usage. BCICPL is not responsible for third party content accessible through the Platform, including opinions, advice, statements and advertisements, and you shall bear all risks associated with the use of such content. BCICPL is not responsible for any loss or damage of any sort which you may incur from dealing with any third party.
    2. By using any third-party content, you may leave the Platform and be directed to an external website / browser, or to a website maintained by an entity other than BCICPL. If you decide to visit any such site, you do at your own risk and it is your responsibility to take all protective measures to guard against viruses or any other destructive elements. BCICPL makes no warranty or representation and does not endorse, any linked websites or the information appearing thereon or any of the products or services described thereon. Links do not imply that BCICPL endorses, is affiliated or associated with, or is legally authorized to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links, or that any linked site is authorized to use any trademark, trade name, logo or copyright symbol of BCICPL. You hereby expressly acknowledge and agree that the linked sites are not under the control of BCICPL and BCICPL is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. BCICPL is providing these links to you only as a convenience, and the inclusion of any link shall not be construed to imply endorsement by BCICPL in any manner of the website.
13. LEGALITIES:
    1. You hereby specifically agree to comply with the requirements of the Information Technology Act, 2000 and abide by the rules, regulations, guidelines, bye laws and notifications made there under the law and any-other law as specified while on the Platform. You also undertake that the content provided by you is not defamatory, obscene, threatening, abusive or hateful. You shall alone be responsible for all of your acts, deeds and actions and will alone be held reasonable and liable for civil and criminal liabilities.
    2. Investment in the securities market including mutual fund investments are subject to market risks. Please read all investments, offer and scheme related documents carefully, before investing.
    3. The Terms shall be governed by the Laws of India. The Court of law at Mumbai Presidency / Metropolitan holds exclusive jurisdictional right to trail any disputes arising out of, or under the Terms.
14. COMMUNICATION:
    1. BCICPL may, if you so choose send direct mailers to you at the address given by you. You have the option to 'opt-out' of this direct mailer by way of links provided at the bottom of each mailer. BCICPL respects your privacy and in the event that you choose to not receive such mailers, BCICPL will take all steps to remove you from the mailing list.
    2. BCICPL recognizes the receipt, transmission or distribution of spam emails (unsolicited bulk emails) as a major concern and has taken reasonable measures to minimize the transmission and effect of spam emails in its computing environment. All emails received by BCICPL are subject to spam check. Any email identified as spam will be rejected with sufficient information to the Sender for taking necessary action. With this measure, along with other technical spam reduction measures, BCICPL reserves the right to reject and/or report any suspicious spam emails, to the authorities concerned, for necessary action, from time to time.
    3. No failure or delay by BCICPL in exercising any right, power or privilege under the Terms will operate as a waiver of it, nor will any single or partial exercise of it preclude any further exercise or the exercise of any right, power or privilege under the Terms.
    4. The Platform is controlled, operated and administered by BCICPL from its offices within India. BCICPL makes no representation that Materials on the Platform are appropriate or available for use at any other location(s) outside India. Any access to this site from territories where their contents are illegal is prohibited. You may not use the Platform or export the materials in violation of any applicable export laws and regulations. If you access this site from a location outside India, you are responsible for compliance with all local laws.

Investments in mutual fund are not obligations of or guaranteed by the Bluechip Corporate Investment Centre Private Limited (BCICPL) and are subject to investment risks.
2. The information contained on the Platform, including text, graphics, links or other items are provided on an 'as is', 'as available' basis. BCICPL does not warrant the accuracy, adequacy or completeness of this information and material and expressly disclaims liability for errors or omissions in this information and material. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given in conjunction with the information and materials.
3. In no event will BCICPL be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the Platform or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if BCICPL, or representatives thereof, are advised of the possibility of such damages, losses or expenses. Any complaints or concerns with regards to content or to report any abuse of laws or breach of these Terms, may be taken up with the designated Grievance Redressal Officer as mentioned below by sending an email to the respective email id: mfonline@bluechipindia.co.in and upon lodging your complaints, you agree to provide complete support to the Grievance Redressal Team with such reasonable information as may be sought by them form you along with necessary documents, emails, screenshots, as available with you forming part of the complaint. The decision of the Grievance Redressal Team on the complaints shall be final and you agree to be bound by the same.
